Agreement. You are completing an online order at the Publisher's website for a product. In order to complete your purchase, you must (1) read these Terms and Conditions, and (2) click on the order button or send in the mail-in order form. Once you do so, these Terms and Conditions are a binding agreement between you and the Publisher.
Disclaimer. The book "Rescue Your Back" expresses the views and opinions of the Author and not necessarily the views and opinions of the publisher. The information in this book is intended primarily as a means of creating awareness of an alternative approach to back pain and to provide guidelines to increase your potential for success. The information presented is not intended to replace the services of trained health professionals or be a substitute for medical care. Every person is unique and the information presented may not be appropriate for your specific situation. You are to USE THE HELP OF A LICENSED PHYSICAL THERAPIST to determine if this approach is appropriate for you. If you choose to use this information, YOU AGREE to the terms contained herein. IF YOU DO NOT AGREE then PLEASE do not submit your order.
Purchase and Payment. Under this Agreement, Publisher agrees to provide to you, and you agree to purchase from Publisher, the product described in your Order Form. You also agree to pay the purchase price shown on the Publisher's website for the product that you have ordered. All amounts are stated in U.S. dollars and purchase prices are exclusive of shipping and handling charges and any applicable taxes, customs or duties.
Guarantee. Publisher may offer a time-limited, money-back guarantee on its products. If there is a guarantee applicable to the product that you have purchased, that guarantee is as set out on the applicable product page of the Publisher's website at the time you purchased the product (the "Guarantee"). If during the time-limited period of your Guarantee period you are not satisfied with the product you purchased, Publisher will refund the purchase price to you in accordance with the Return Policy set forth below. This is your sole and exclusive remedy against Publisher and Publisher's sole and exclusive liability and obligation to you in connection with your purchase of any product or anything arising out of or relating to that purchase or this Agreement.
Refunds/Returns. If you are not satisfied with the product or service you purchased, Publisher will refund the purchase price to you in accordance with the Guarantee set out on the applicable product page of the Publisher's website at the time of your purchase. In order to ensure your returned merchandise is credited properly, you must first contact us in order to obtain a return authorization number. Our contact information is provided on the Contact Us page above. Proof of purchase is required, so retain any invoices or receipts provided at the time of your purchase. You will be instructed on where to send your returns. Packages without a proper return authorization may not be accepted. Shipping and handling charges are not refundable.
Copyright. Publisher's products and any other materials that you may receive from Publisher are the exclusive property of Publisher and are protected by copyright and other applicable laws and are for your own personal use. You may not copy any portion of the products, services, or materials, without the prior written permission of Publisher, or distribute copies of Publisher's products, services, or materials to others.
Limitation Of Liability. Notwithstanding any other provision of this Agreement, and to the maximum extent permitted by applicable law, the following shall apply: (1) Publisher's liability (if any) under this Agreement or otherwise is limited to the purchase price paid by you for the Product, and in no event will Publisher be liable to you or any other person for any indirect, consequential, special, incidental, punitive or other loss or damage, arising from, connected with, or relating to this Agreement, the subject matter of this Agreement, any Product or Service, or otherwise, under any theory of liability (whether in contract, tort, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongdoing (including fundamental breach or gross negligence) by Publisher or any person for whom Publisher is responsible, and even if Publisher has been advised of the possibility of such potential loss or damage being incurred; (2) and in no event will Publisher's total aggregate liability to you or any other person under this Agreement or otherwise, under any contract, negligence, strict liability or other legal or equitable theory, regardless of any negligence or other fault or wrongdoing (including any breach or gross negligence) by Publisher or any person for whom Publisher is responsible, and even if Publisher has been advised of the possibility of such potential loss or damage being incurred, exceed the purchase price paid by you to Publisher for the Products. Under this paragraph, "Publisher" includes Publisher and any of its past, present and future members, officers, employees, agents, representatives, subcontractors, service providers, successors, permitted assigns, and heirs. The exclusion or limitation of certain liabilities is prohibited by law in some jurisdictions and may apply to you.
Governing Law and Disputes. This Agreement and all related matters will be governed by and interpreted in accordance with the laws of the State of Maryland and the federal laws of the United States applicable therein without regard to conflict of laws rules. All disputes relating to this Agreement shall be resolved before the Courts of the State of Maryland, and you hereby irrevocably submit to the jurisdiction of the courts of the State of Maryland and waive any objection that you may now or hereafter have based on inconvenient forum for such proceedings. The United Nations Convention on the International Sale of Goods will not apply to this Agreement.
Miscellaneous. You represent that you are of legal age to enter into binding contracts under the laws of the jurisdiction where you reside. If any provision of this Agreement is held to be invalid or unenforceable for any reason, then the provision will be deemed severed from this Agreement and the remaining provisions will continue in full force and effect. This Agreement will enure to the benefit of and be binding upon the parties and their respective heirs, executors, administrators, personal representatives, successors and assigns. This Agreement sets forth the entire agreement and understanding between you and the Publisher with respect to the subject matter of this Agreement and supersedes any and all previous communications, representations, negotiations, discussions, agreements or understanding, whether oral or written, between you and the Publisher with respect to the subject matter of this Agreement.

How do we protect your information?
We implement a variety of security measures to maintain the safety of your personal information when you place an order. We offer the use of a secure PayPal server. All supplied sensitive/credit information is transmitted via PayPal's Secure Socket Layer (SSL) technology and then encrypted into PayPal's database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers but will be stored on Paypal servers if you use their services.
Do we use cookies?
We do not use cookies but Paypal does.
Do we disclose any information to outside parties?
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
California Online Privacy Protection Act Compliance
Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent.
Childrens Online Privacy Protection Act Compliance
We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), we do not collect any information from anyone under 18 years of age. Our website, products and services are all directed to people who are at least 18 years old or older.
